This study aims to analyze the requirements for dismissal of preliminary trial of repetitive cases, ie the art. 285 -A of the Code, introduced by Law 11,277/2006, and to analyze its compliance with the constitutional principles. It addresses the main divergent points in the doctrine of the art application requirements 285 -A. It was found that the device in question is in full compliance not only with the constitutional principles of the process, as well as with the current civil procedural system that excels in speed. Finally, he concludes that in order to give priority to the principle of reasonable duration of the process, art. 285 -A is in an important tool for trial without undue delay.Downloads
